BLOOM FRESH secures landmark ruling in China over Sweet Sapphire™ infringement

BLOOM FRESH has achieved a significant legal victory in China after the Supreme People’s Court (SPC) upheld an administrative penalty issued by the Binchuan Bureau of Agriculture and Rural Affairs against a grower in Yunnan. The case concerned the unauthorised production and sale of the protected grape variety IFG Six, marketed under the SWEET SAPPHIRE™ brand

The ruling brings to a close a multi-year dispute linked to extensive illegal plantings of IFG Six in one of China’s leading grape-growing regions.

In its decision, the SPC confirmed that the grower had infringed BLOOM FRESH’s plant variety rights (PVR), validated the fine imposed by the local authority and endorsed the destruction of all propagation material. The court described the measure as “lawful and appropriate”.

With the appeal dismissed at the highest judicial level, the sanction imposed by the local authority will now be fully enforced.

Legalisation programme completed and enforcement steps up

The court decision coincides with the completion of the IFG Six legalisation programme in China, which concluded on 31 October 2025. With this process now closed, BLOOM FRESH has confirmed it will actively pursue any detected infringements in order to safeguard authorised growers and preserve the quality and reputation of SWEET SAPPHIRE™ in the Chinese market.

“The ruling provides certainty and protection for legitimate producers and sends a clear message to nurseries, marketers and retailers about the importance of operating within a lawful value chain,” he added.

BLOOM FRESH also confirmed that it will continue to take action against illegal production and propagation of IFG Six across China, while further strengthening the SWEET SAPPHIRE™ brand through technical, commercial and marketing support.
